Keeping An Eye on Current Legal Situation

Food laws are constantly subject to changes and modifications based on the results of current research and studies. In order to avoid administrative complaints by food control authorities and to provide safe food and supplements to the consumers we actively keep on track with current food laws in Europe. In case of any changes that require immediate adjustments of recipes and declaration we inform our B2B customers right away.


The ban of titanium dioxide


Titanium dioxide (E171) for instance was an authorized food additive used as a white colouring agent and carrier for other colour pigments. It was commonly used as coating for tablets. According to latest scientific opinions titanium dioxide can no longer be regarded as non-genotoxic which means that it is potentially genetically harmful. The legally consolidated precautional principles state that measures have to be taken whenever the safety of a certain food is scientifically doubted even though not entirely approved. Regarding titanium dioxide things have led to a ban in food.


The process of prohibition


Titanium dioxide (E171) has already been banned in France since January 2020. By attentive monitoring of general European laws we can conclude future legal changes in Germany. In October 2021 all EU member states approved the suggestion of the European Commission to prohibit the use of titanium dioxide as additive in food as of 2022. If no rejections came up the law was supposed to become effective as of the beginning of 2022. For this reason we checked the formulas of our customers’ products for titanium dioxide and prepared the adjustment processes in close cooperation with our customers and R&D. Thereby, we were able to deplete the existing packaging material stocks whilst working on the creation of new formulas and artworks. Eventually, EU regulation 2022/63 entered into force on 7 February 2022 prohibiting the use and sale of titanium dioxide as food additive. During the six month transition period remaining stocks should have been depleted and placed on the market until 7 August 2022. After that, they are allowed to remain there until their BBD.
